Please read carefully this entire warranty document, to fully understand the warranty offered to our customers.
AtomicScooter LLC, offers our customers a 180 day/2000km limited warranty from the date of delivery of your scooter. Limited warranty is for defects from the manufacturer only. Should purchaser have a part that needs replacing, they should immediately email us at contact@atomicscooter.com.
We recommend that you contact a certified small engine mechanic to perform repairs on your vehicle. Any damages that occur due to misuse or improper care of the vehicle including but not limited to exceeding the weight limit (240lbs), shipping damages, accidents, or gross misuse of normal intended operations are not covered under the warranty. WARNINGS
Our scooters are not for use for children under 16 years old. This product is to be operated in accordance with all city, state, county, and federal laws. Always wear eye protection, a helmet, and protective clothing. Never carry passengers (unless you own the Euro). Be particularly careful on difficult terrain. Never engage in stunt riding. Riding and alcohol/drugs don't mix. Avoid excessive speed. Remember to ride your AtomicScooter vehicle using common sense and avoiding recklessness.
RISKS INHERENT TO OPERATION
Operating an AtomicScooter vehicle involves risks and dangers involving serious bodily injury. These risks and dangers also include but are not limited to paralysis, disability, dismemberment, and death. These inherent risks may be the result of purchaser's own actions or non-actions involving: themselves, others, or specific circumstances of the activity occurring, or the neglect or negligence of themselves and or others. There may be other risks known or unknown to Purchaser. Purchaser assumes all risks and fully assumes and accepts responsibility for events that may not be foreseeable including economic loss, social distress, losses, costs, and damages caused as a result of person's vehicle riding activities.
PURCHASING RESPONSIBILITIES
Purchaser understands the nature of riding motor vehicles and motorcycle riding activities and acknowledges that he or she is qualified to operate a scooter as purchased from AtomicScooter. Person understands that they must abide by state laws and be in proper physical condition to ride an AtomicScooter vehicle. If purchaser is not familiar with how to operate an AtomicScooter vehicle, purchaser should seek professional training and be fully competent before riding their scooter. Purchaser is also responsible to inspect and insure motor vehicle before using it to make sure that the motor vehicle is safe to use and in riding order.
LICENSING & REGISTRATION
Laws vary from state to state, and AtomicScooter makes no guarantees or claims that the motor vehicle you purchase is legal for operation in your particular city, county, or state. If required in your city or state, purchaser is responsible to operate and register motor vehicle in accordance with state and local laws and ordinances. Every scooter comes with a Certificate of Origin, from the factory. We can also provide a Bill of Sale, if needed. If you need one, email us at contact@atomicscooter.com. The scooter has an engraved VIN nameplated on the scooter. Beyond that, we can not provide any further documentation or paperwork.
THIS LIMITED WARRANTY COVERS THE FOLLOWING PARTS:
ENGINE : Engine long block assembly, including all internal lubricated parts, i.e. rings, pistons, pins, crankshaft and, main bearings, the connecting rods, and rod bearings, camshaft bearings, timing chain gears, rocker arms, valve springs, valve guides, valve seats, valve push rods, valve lifters, and oil pump. Additionally, the engine head (s), engine block and cylinder barrels will be covered if they are solely as a result of the mechanical failure of one or more of the internal lubricated components specified above. The Cooling system must be in good working order including cooling fans.
TRANSFER CASE : All internal lubricated parts contained within the transfer case. The transfer case itself will be covered if damage solely as a result of the mechanical failure of one or more of the internal lubricated components contained within the transfer case.
DIFFERENTIAL : All internal lubricated parts contained within the drive axle housing case. The drive axle housing itself if damaged solely as a result of the mechanical failure of one or more or the internal lubricated components contained the drive axle housing.
TRANSMISSION (Automatic or Standard) : All internal lubricated parts contained within the transmission case. The transmission case itself if damaged solely as a result of mechanical failure of one or more of the internal lubricated components contained within the transmission case. The complete hydraulic system must be flushed including integral transfer case, oil cooler, lines, and new filter(s) installed.
THIS LIMITED WARRANTY DOES NOT COVER THE FOLLOWING PARTS :
1. Tires
2. All belts
3. Brake parts
4. All cables
5. All filters
6. Spark plugs
7. Bulbs
8. Batteries
9. Sprockets
10. External springs
11. Seat and hand grips
12. Rubber parts
13. Cracked or scratched body panels
We offer an exception to all of these non-covered parts. Within two days of taking receipt of your ATV, if any of these parts are defective or missing, we will replace them under warranty under these circumstances.
1. We must be contacted in writing by emailing us at contact@atomicscooter.com within the two day time period.
2. The ATV has not been ridden.
3. We will require a photo of the defective part, and in some cases, the actual part will have to be shipped to us before a replacement part can be shipped. All labor, including removing the defective parts and replacing them, is not covered by AtomicScooter.
COVERAGE AND LIMITATIONS
IMPORTANT : You must have a professional mechanic (a small engine repair shop, motorcycle shop, or local auto repair shop) assemble your new ATV and do the prep work to assure your ATV is in good working condition.
We recommend having a professional mechanic perform warranty work on your ATV.
Subject to the limitations stated in this agreement, AtomicScooter agrees (at its election) to replace a covered component if the covered component fails within the component stated warranty period from the date of purchase, while the component is being used under the conditions and in the manner specified by its original manufacturer.
LABOR TO REPAIR OR REPLACE PARTS: AtomicScooter does not pay for labor for the removal and replacement of such component (s) or part (s).
IMPORTANT NOTES
This warranty does not include labor, wearable parts or damaged parts from accidents, abuse, or shipping. If you have a part that needs replacing, please contact us and we'll send the part within 5 days, or let you know the lead time for the part. In some cases, the parts may have to be shipped from overseas and may take up to 8 weeks for delivery.
All warranted parts must first be sent to our Parts Department, at the owner's expense, for inspection and testing for defects. Until the parts are sent to us, replacement parts will not be sent under warranty. Contact our Parts Dept. at contact@atomicscooter.com.
Items and conditions that are specifically excluded from this warranty program are :
• Damage caused by accidents, misuse, negligence or improper vehicle operation.
• Any modifications or alteration of any standard specifications or equipment.
• Damage caused by failure to perform factory recommended service maintenance.
• Damage which occurs as a result of improper storage.
• Damage caused by the use of improper fuel or lubricants.
THIS AGREEMENT AND LIMITED WARRANTY IS VOID IF :
1.ATOMICSCOOTER IS NOT PROVIDED A REASONABLE OPPORTUNITY FOR INSPECTION OF A COVERED COMPONENT PRIOR TO REMOVAL, REPAIR OR REPLACEMENT OF ANY COVERED COMPONENT.
2. THE DAMAGE TO THE COMPONENT IS CAUSED BY A NON-COVERED COMPONENT OR PART OR BY ANY PART OR COMPONENT NOT PURCHASED FROM ATOMICSCOOTER .
3. THE CUSTOMER FAILS TO FOLLOW THE MINIMUM MAINTENANCE AND BREAK-IN REQUIREMENTS SUGGESTED BY THE MANUFACTURER, AND/OR FAILS TO PROVIDE PROPER SERVICE DOCUMENTS.
LIMITED WARRANTY TRANSFERABILITY
This Agreement is provided to the original purchaser and is non transferable.
NO IMPLIED WARRANTIES OR AGREEMENTS: THERE ARE NO AGREEMENTS OR WARRANTIES, EXPRESSED OR IMPLIED INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE STATED IN THIS AGREEMENT. AtomicScooter SHALL NOT BE RESPONSIBLE FOR THE PAYMENT OF DAMAGES, OTHER THAN THE SUMS SPECIFIED IN THIS AGREEMENT AND LIMITED WARRANTY, FOR INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE ARISING FROM INJURY, LOSS OF USE, LOSS OF TIME, RENTAL VEHICLES, PROFITS, OR INCOME TO THE CUSTOMER AS A RESULT OF A FAILURE OF ANY COMPONENT OR PART.
TOWING CHARGES : All towing charges incurred are the responsibility of the customer.
NO OTHER AGREEMENT : There are no other agreements between the parties with regards to the components purchased except as stated in this agreement & limited warranty.
IMPORTANT: ALL SALES ARE FINAL. RETURNS OR EXCHANGES ARE NOT OFFERED BY AtomicScooter UNDER ANY CIRCUMSTANCES.
